Differences in permitted amounts of magnesium in food supplements in the EU

The marketing of dietary supplements in other countries requires particular attention, with regard to. This is because the requirements for permitted amounts of active ingredients, e.g. vitamins or minerals, are not harmonised at EU level. Let us take magnesium as an example.
In Poland, according to Dietary Supplements Panel Resolution No. 19/2019, the maximum daily portion of magnesium in dietary supplements for adults is 400 mg. In other Member States, the permitted level of this mineral is between 250 mg and 450 mg per day.

So how do you determine the composition of a product entering several EU markets?

In the case of differences in maximum permissible quantities, the safe solution is to adopt the lowest permissible level. Alternatively, entrepreneurs can use the mutual recognition procedure under Regulation 2019/515. It is permissible to create several product variants tailored to the requirements of the legal environment in question.


In the case of a target market in a third country (e.g. UK, USA), it is necessary to ensure compliance with local legislation on dietary supplements.
